HOUSE BILL 2400

 

 

 

AN ACT

 

amending Arizona Revised Statutes by adding title 18; relating to information technology.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  The Arizona Revised Statutes are amended by adding title 18, to read:

INFORMATION TECHNOLOGY

CHAPTER 4

BUSINESS LICENSING

ARTICLE 3.  GENERAL PROVISIONS

START_STATUTE18-446.  Business licensing; electronic database; exemption; definitions

A.  Notwithstanding any other law and subject to legislative appropriation, an agency that has approved an applicant for a business license shall forward the approved application to the secretary of state.

B.  The secretary of state shall establish and maintain an electronic database of all business licenses issued by a city, town or county that is electronically searchable by the public.

C.  If an agency has approved an applicant for a business license, the agency shall forward the following information for each licensee to the secretary of state to be entered into the electronic database established pursuant to subsection B of this section:

1.  The licensee's name and contact information.

2.  The name of the business.

3.  The issue date of the business license.

4.  The expiration date of the business license.

D.  This section does not apply to licenses issued by the department of gaming pursuant to the tribal-state gaming compact signed in 2003.

E.  For the purposes of this section:

1.  "Agency" means any city, town or county that issues a license. Agency does not include the corporation commission.

2.  "License" means any certificate, registration or license that is required by law and that is issued by any agency For the purpose of operating a business in this state. END_STATUTE

Sec. 2.  Conforming legislation

The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fifty‑second legislature, second regular session.

Sec. 3.  Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
