AN ACT
amending Title 15, chapter 3, article 6, Arizona Revised Statutes, by adding section 15-397; relating to joint technical education districts.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 15, chapter 3, article 6, Arizona Revised Statutes, is amended by adding section 15-397, to read:
15-397. Transportation of homeschooled children
A. Notwithstanding section 15‑342, If a local education agency provides pupil transportation services to and from the campus of a joint technical education district pursuant to section 15‑393, subsection l, paragraph 6 and this section, the local education agency shall provide transportation to and from that campus for homeschooled children who reside within the boundaries of the local education agency and who are enrolled in a program or course offered at the campus of the joint technical education district. The local education agency is not obligated to change its bus routes or add bus stops to accommodate homeschooled children.
B. Children who are transported by a local education agency pursuant to section 15‑393, subsection l, paragraph 6 and this section shall comply with the local education agency's bus conduct rules. The local education agency may exclude children from transportation by the local education agency for misconduct.
C. the local education agency shall be reimbursed for fuel costs and for expenses related to adding equipment, staff or routes to accommodate the pupil transportation required by section 15‑393, subsection l, paragraph 6 and this section, except that the local education agency may not charge for costs that it already incurs for staff and equipment to transport the local education agency's enrolled pupils pursuant to section 15‑393, subsection l, paragraph 6.
D. A joint technical education district shall provide any identification information and indemnification that is required by A local education agency for the transportation of homeschooled children.
E. This section does not require a local education agency to transport homeschooled children pursuant to this section if there is insufficient seating available for those children.
