AN ACT
amending title 38, chapter 3, Arizona Revised Statutes, by adding article 11; amending title 41, chapter 10, article 1, Arizona Revised Statutes, by adding section 41-1511; appropriating monies; relating to electric vehicles.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 38, chapter 3, Arizona Revised Statutes, is amended by adding article 11, to read:
ARTICLE 11. GOVERNMENT VEHICLES
38-539. Government vehicles; electric; reimbursement; definition
A. If purchasing new motor vehicles, state agencies and political subdivisions shall consider electric vehicles and the long-term maintenance and fuel costs in evaluating the total costs over the life of the motor vehicle.
B. A political subdivision may apply to the department of administration for reimbursement for the difference between the amount that the political subdivision spent on the purchase price of the electric vehicles and the amount that the political subdivision would have spent on the purchase price of the fossil fuel vehicles if the purchase price of the electric vehicles was more than the purchase price of the fossil fuel vehicles. The department of administration may establish a reimbursement cap for each political subdivision. The department of administration shall reimburse political subdivisions on a first-come, first-served basis from monies appropriated for this purpose.
C. For the purposes of this section, "political subdivision" means a county, city or town.
Sec. 2. Title 41, chapter 10, article 1, Arizona Revised Statutes, is amended by adding section 41-1511, to read:
41-1511. Electric vehicle charging station grant pilot program; report
A. The authority shall administer an electric vehicle charging station grant pilot program to offset the cost of installing electric vehicle chargers in underserved, rural areas of this state. The authority shall give PRIORITY to a grant applicant that plans to install a level three fast charging direct current charging station in an area WITHOUT access to level three chargers. To be eligible for grant monies, a charging station must be available for the general public to use, either for a fee or for free. The authority may award Grants for all or part of the cost of installing electric vehicle charging STATIONS. GRANTS under this section are subject to the availability of monies. The authority may accept gifts or grants from any federal or state agency, municipality, private organization or other source to be applied to the electric vehicle charging station grant pilot program.
B. One year after the authority begins administering the electric vehicle charging station grant pilot program, the authority shall submit a report to the president of the senate, the speaker of the house of REPRESENTATIVES and the governor and shall provide a copy of this report to the SECRETARY of state. The report shall detail the results of the electric vehicle charging station grant pilot program, including an estimate of the volume of greenhouse gas emissions that were avoided as a result of vehicles using the electric vehicle charging stations.
Sec. 3. Appropriation; department of administration; electric vehicle reimbursement; exemption
A. The sum of $1,000,000 is appropriated from the state general fund in fiscal year 2022-2023 to the department of administration to distribute to political subdivisions for electric vehicle reimbursement pursuant to section 38-539, Arizona Revised Statutes, as added by this act.
B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
Sec. 4. Appropriation; Arizona commerce authority; electric vehicle charging station grant pilot program; exemption
A. The sum of $1,000,000 is appropriated from the state general fund in fiscal year 2022-2023 to the Arizona commerce authority for administering the electric vehicle charging station grant pilot program pursuant to section 41-1511, Arizona Revised Statutes, as added by this act.
B. The appropriation made in subsection A of this section is exempt from the provisions of section 35-190, Arizona Revised Statutes, relating to lapsing of appropriations.
