AN ACT

 

amending section 28‑5240, Arizona Revised Statutes; relating to motor carrier safety.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Section 28-5240, Arizona Revised Statutes, is amended to read:

START_STATUTE28-5240.  Civil penalty; violation; classification; attorney general enforcement

A.  In addition to any other civil penalties imposed under this chapter, a motor carrier, shipper or manufacturer who that operates or causes to be operated a commercial motor vehicle in violation of this chapter or who that knowingly violates or knowingly fails to comply with any provision of this chapter or with any rule adopted pursuant to this chapter is guilty of:

1.  A class 2 misdemeanor subject to a civil penalty of $1,000 for a first offense violation.

2.  Guilty of a class 1 misdemeanor for a second offense violation within six months after the preceding violation.

3.  Guilty of a class 6 felony for any subsequent offense violation within one year after the preceding violation.

B.  The attorney general may enforce this section. END_STATUTE
