AN ACT
Amending title 44, CHAPTER 1, ARTICLE 3, Arizona Revised Statutes, by adding section 44-135; relating to CAPACITY to contract.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 44, chapter 1, article 3, Arizona Revised Statutes, is amended by adding section 44-135, to read:
44-135. Capacity of a minor who is a parent to consent to medical treatment; definition
A. Notwithstanding any other law, a minor who is at least sixteen years of age, who is a custodial parent and who is otherwise competent may consent to the minor's own medical treatment, and the consent of the minor's parent or legal guardian is not necessary to authorize hospital or medical care except for an elective procedure.
B. Consent given pursuant to this section is not subject to disaffirmance because of minority.
C. For the purposes of this section, "elective procedure" means any procedure chosen by the patient that is advantageous to the patient but is not medically necessary. Abortion as defined in section 36-2151 is an elective procedure unless it is deemed a medical emergency as defined in Section 36-2151.
