AN ACT

 

amending Title 15, chapter 2, article 1, Arizona Revised Statutes, by adding section 15-213.04; relating to school district procurement.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 15-213.04, to read:

START_STATUTE15-213.04.  Solar panel systems; maximum payments; enforcement

A.  Notwithstanding any other law, a solar company may charge a school district that installs a solar panel system only for the energy used by the school district.

B.  The attorney general, the county attorney for the county in which an alleged violation of subsection A of this section occurs or any resident of the affected school district may file an action for breach of contract or fraud, or both, in the superior court.  END_STATUTE
