AN ACT

 

amending Title 15, chapter 1, article 1, Arizona Revised Statutes, by adding section 15-119; Repealing title 41, chapter 33, Arizona Revised Statutes; amending title 41, Arizona Revised Statutes, by adding a new chapter 33; relating to public contracts.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 1, Arizona Revised Statutes, is amended by adding section 15-119, to read:

START_STATUTE15-119.  Contracts; verification software

A.  A contract that is entered into by or on behalf of a school district or charter school for professional or technical services in excess of $100,000 shall require a contractor to use software to verify that hours billed for work under the contract that are performed on a computer are legitimate.

B.  The software shall:

1.  Allow the school district or charter school or an auditor of the school district or charter school to have real‑time or retroactive access to data that is collected or provided by the software.

2.  Automatically gather verification data of state-funded activity by tracking total keystroke and mouse event frequency and taking a screenshot at least once every three minutes.

3.  Provide to the school district or charter school or an auditor of the school district or charter school automated real-time cost status of each task.

4.  Provide to the school district or charter school professional biographical information.

5.  Protect all data on individuals that is private or confidential.

6.  Allow the school district or charter school to provide immediate feedback to the contractor on work in progress.

C.  The data collected by the software shall be considered accounting records belonging to the contractor.  The contractor shall store or contract with another entity to store the data collected by the software for a period of seven years and shall provide access to the contracting agency or state auditors on request.

D.  The contractor may not charge the school district or charter school or an auditor of the school district or charter school for access to or use of the work verification software or for access to or retrievals of data collected by the software.

E.  The contractor shall procure the software used pursuant to this section from an independent entity. END_STATUTE

Sec. 2.  Repeal

Title 41, chapter 33, Arizona Revised Statutes, is repealed.

Sec. 3.  Title 41, Arizona Revised Statutes, is amended by adding a new chapter 33, to read:

CHAPTER 33

STATE CONTRACTS

ARTICLE 1.  GENERAL PROVISIONS

START_STATUTE41-3501.  Contracts; verification software

A.  A contract that is entered into by or on behalf of any state agency and the governor's office for professional or technical services in excess of $100,000 shall require a contractor to use software to verify that hours billed for work under the contract that are performed on a computer are legitimate.

B.  The software shall:

1.  Allow the agency or an auditor of the agency to have real‑time or retroactive access to data that is collected or provided by the software.

2.  Automatically gather verification data of state-funded activity by tracking total keystroke and mouse event frequency and taking a screenshot at least once every three minutes.

3.  Provide to the agency or an auditor of the agency automated real-time cost status of each task.
