A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §59-1-2c, relating to the voluntary deposit of refunds for the overpayment of fees to the Children’s Trust Fund.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §59-1-2c, to read as follows:
ARTICLE 1. FEES AND ALLOWANCES.
§59-1-2c. Voluntary donation of certain refunds.
The Secretary of State shall provide a mechanism by which any overpayment of $25 or less of any fee authorized by this or any other chapter of this code to the Secretary of State may be deposited in the West Virginia Children’s Trust Fund authorized by section one, article six-c, chapter forty-nine of this code: Provided, That any person due a refund of $25 or less for overpayment of fees must voluntarily and affirmatively choose for such refund to be deposited in the West Virginia Children’s Trust Fund.
NOTE: The purpose of this bill is to allow a voluntary donation of refunds for overpayment of fees to the Secretary of State’s office to the West Virginia Children’s Trust Fund.
