A BILL to amend and reenact §18-28-4 of the Code of West Virginia, 1931, as amended, relating to voluntary participation in state education programs.

Be it enacted by the Legislature of West Virginia:


ARTICLE 28. PRIVATE, PAROCHIAL OR CHURCH SCHOOLS, OR SCHOOLS OF A RELIGIOUS ORDER.


§18-28-4. Voluntary participation in state programs.

(a) Any private, parochial, or church school or school of a religious order or other nonpublic school complying with the provisions of this article may, on a voluntary basis, participate in any state operated or state sponsored program otherwise made available to such schools by law.

(b) Upon request by the administration of any private, parochial, or church school of a religious order or other nonpublic school, county boards of education shall make such programs available: Provided, That county administrators shall publish the student limits to each program prior to the opening of enrollment; and the published student threshold has not been exceeded.
