A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §31-20-27b, relating to providing civil service status for certain employees of the Regional Jail and Correctional Facility Authority.

Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §31-20-27b, to read as follows:
ARTICLE 20. WEST VIRGINIA REGIONAL JAIL AND CORRECTIONAL FACILITY AUTHORITY.

§31-20-27b. Employees of Regional Jail and Correctional Facility Authority central office; civil service coverage.

(a) Notwithstanding any provision of this code to the contrary, the authority, when hiring employees at the office of the executive director, or central office, shall do so at a salary and with benefits consistent with the approved plan of compensation of the Division of Personnel, created under section five, article six, chapter twenty-nine of this code. All persons employed in the office of the executive director, the central office, under this subsection shall also be covered by the policies and procedures of the education and state employees grievance board, created under article three, chapter six-c of this code.
(b) All employees of the Regional Authority Jail and Correctional Facility Authority, central office and Training Academy, wherever so situated, with exception of the executive director, deputy director, operations managers, regional jail administrators under command of the central office, are to be placed under the civil service coverage. All other central office employees shall be placed under civil service status on and after July 1, 2011 and new hires after July 1, 2011 to become civil service employees thirty days after hire.
(c) This section is effective July 1, 2011.




NOTE: The purpose of this bill is to provide that, on and after July 1, 2011, employees not presently under civil service coverage in the Regional Jail and Correctional Facility Authority central office be placed under civil service coverage, with specified exceptions.
