A BILL to amend and reenact §29-3E-10 of the Code of West Virginia, 1931, as amended, relating to fireworks safety; and authorizing a municipality to prohibit the sale of fireworks within its boundaries.
Be it enacted by the Legislature of West Virginia:
That §29-3E-10 of the Code of West Virginia, 1931, as amended, be amended and reenacted to read as follows:
ARTICLE 3E. FIREWORKS SAFETY.
§29-3E-10. Local municipalities’ regulation of consumer fireworks.
This article does not affect the authority of the governing body of a municipality to prohibit the sale of or to regulate the use of consumer fireworks within its boundaries.
NOTE: The purpose of this bill is to authorize a municipality to prohibit the sale of fireworks within its boundaries.
