COMMENTS: Bill calls for a study to determine an equitable solution when a tenant in a sober living home ceases his or her participation in the recovery residence’s program and therefore must vacate the premises. The bill further provides that in such event, the recovery residence must refund prorated, per diem, rent to the discharged person within 72 hours. If the person was transported to Cabell County for the purpose of participation in the program, the residence must also provide return travel expenses to the place of origin. The bill goes on to require the Bureau of Behavioral Health to prepare and submit a written report to the Joint Committee on Government Finance setting forth specific enumerated information by July 1, 2023. Finally, the bill clarifies the extent to which actions for wrongful occupation of residential property apply to recovery houses.
