13100833D Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding a section numbered 54.1-3013.2 as follows: §54.1-3013.2. Nursing education program minimum examination passage rates. A. Every nursing education program approved pursuant to §54.1-3013 shall maintain a passage rate for graduates taking the national licensing examination required for licensure as a professional or practical nurse for the first time that is not lower than 10 percentage points less than the national average passage rate for graduates of comparable nursing education programs taking the national licensing examination for the first time, as calculated by the National Council of State Boards of Nursing. B. Whenever an approved nursing education program fails to meet the minimum passage rate established pursuant to subsection A in two consecutive years, the Board shall cause a survey of the nursing education program to be made by the administrative officer or other authorized employee of the Board, who shall submit a written report of the survey to the Board. If the Board determines that the approved nursing education program is not maintaining the passage rate required pursuant to subsection A, the Board shall notify the institution conducting the approved nursing education program in writing of the deficiency and may, after an informal fact-finding proceeding held pursuant to §2.2-4019, place the program on conditional approval with terms and conditions as set forth in §54.1-3014. |
