AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee for Courts of Justice
on February 5, 2014)

A BILL to amend the Code of Virginia by adding a section numbered 19.2-303.6, relating to certain felony convictions.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 19.2-303.6 as follows:

§19.2-303.6. Felony conviction may be reduced to misdemeanor under certain conditions.

Notwithstanding any other provision of law or any rule, subsequent to a conviction of a felony, the court shall have jurisdiction to amend a conviction of a felony, other than an act of violence as defined in § 19.2-297.1, to a conviction of a misdemeanor pursuant to the terms and conditions of a plea agreement contained in a sentencing order upon the court's determination that those terms and conditions have been fulfilled.
