AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the Senate Committee for Courts of Justice
on February 8, 2012)

A BILL to amend the Code of Virginia by adding in Article 2 of Chapter 9 of Title 18.2 a section numbered 18.2-415.1, relating to disruption of a funeral or memorial service; penalty.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Article 2 of Chapter 9 of Title 18.2 a section numbered 18.2-415.1 as follows:

§18.2-415.1. Disruption of a funeral or memorial service.

A. A person may not address speech to a person attending a funeral or memorial service that is reasonably likely to provoke an imminent breach of the peace.

B. A person may not engage in picketing activity within 250 feet of a funeral or memorial service that is targeted at one or more persons attending the funeral or memorial service.

C. This section does not apply to a person who conducts a funeral or memorial service.

D. A person who violates a provision of this section is guilty of a Class 1 misdemeanor.
