A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 17 of Title 45.2 a section numbered 45.2-1701.2, relating to Department of Energy; data center energy usage.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 17 of Title 45.2 a section numbered 45.2-1701.2 as follows:

§45.2-1701.2. Data center energy source report.

Each data center, as that term is defined in §58.1-3506, located in the Commonwealth shall make a quarterly energy source report to the Division that identifies the amount of energy, disaggregated by the source of energy, consumed by the data center in the previous quarter. The Division shall publish aggregate deidentified data from such reports on its website.

2. That the Secretary of Commerce and Trade (the Secretary) shall convene a work group to estimate the future energy demands of the data center industry in the Commonwealth. The work group shall include representatives from the Department of Energy, the Virginia Economic Development Partnership Authority, the State Corporation Commission, the data center industry, electric utilities, and other interested stakeholders. The Secretary shall report the findings of the work group to the General Assembly by November 30, 2024.
