A BILL to amend the Code of Virginia by adding a section
numbered 8.01-63.1, relating to localities; liability for owning or operating
vehicle.

Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 8.01-63.1 as follows:
§8.01-63.1. Liability of locality owning or operating vehicle.
Notwithstanding any other provision of law, in any case in which a locality is the owner of, or operator through medium of a driver of, or otherwise is the insured under the policy upon a vehicle involved in an accident, or is self-insured, the defense of governmental immunity shall not be a bar to action or recovery of damages arising from such accident against such locality. Any damages recovered pursuant to this section shall not exceed the minimum amounts of insurance required by §46.2-472.
