A BILL to amend and reenact §2.2-4348 of the Code of Virginia, relating to the Virginia Public Procurement Act; prompt payment for services; certain payments under the state plan for medical assistance services exempted.

Be it enacted by the General Assembly of Virginia:

1.  That §2.2-4348 of the Code of Virginia is amended and reenacted as follows:

§2.2-4348. Exemptions.

The provisions of this article shall not apply to the:

1. The late payment provisions contained in any public utility tariffs prescribed by the State Corporation Commission; or

2. Payments to providers of services under the state plan for medical assistance services by the Department of Medical Assistance Services in cases in which the claim is not a clean claim as defined in 42 C.F.R. §447.45 because the Department has initiated an investigation for fraud or abuse related to the claim or a review of the claim for medical necessity.
