Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Article 1 of Chapter 5 of Title 32.1 a section numbered 32.1-137.07 as follows:
§ 32.1-137.07. Out-of-network providers; patient notice and consent.
Every hospital shall (i) provide to any patient scheduled to receive a nonemergency procedure, test, or service to be performed at the hospital, at the time such procedure, test, or service is scheduled, oral and written notice as to whether any health care provider providing any service associated with such procedure, test, or service is outside of the network of providers approved by the patient's health insurance carrier and (ii) if any health care provider providing any service associated with such procedure, test, or service is outside of the network of providers approved by the patient's health insurance carrier, obtain written consent to the provision of such service by such provider prior to performing the procedure, test, or service.
