16104071D Whereas, Frank and Amy Taylor (the Taylors) live at 204 Windway Drive in Orange County; and Whereas, the sewage disposal system for their home was duly inspected in 1995 and a sewage disposal operation permit was issued on October 17, 1995, by the Spotsylvania County Health Department with an effective date of March 22, 1996; and Whereas, an occupancy permit was also issued for the home; and Whereas, the Taylors have experienced numerous backups in the sewage disposal system, which has resulted in damage to the baseboard and carpet in their home requiring replacement of a portion of the baseboard; and Whereas, on October 29, 2015, Absolute Plumbing & Drain Cleaning Services, Inc. (Absolute Plumbing) performed an emergency pump-out of the sewage disposal system and charged the Taylors $355 for such services; and Whereas, in excavating the sewage disposal system, Absolute Plumbing discovered a low spot in the piping from the Taylors' home to the septic tank, which was the cause of the numerous backups; and Whereas, Absolute Plumbing recommended that eight to 10 feet of the piping from the septic tank to the Taylors' home be replaced to eliminate the low spot; and Whereas, Absolute Plumbing also discovered that the intake piping and outtake piping from the sewage disposal tank were actually reversed when installed; and Whereas, the Taylors assert that the improper installation of the sewage disposal system was the proximate cause of the numerous backups they experienced; and Whereas, on December 9, 2015, the Taylors incurred $827.50 in costs to repair the sewage disposal system, including charges for excavation and replacement of approximately 10 feet of lead line into the septic tank; and Whereas, a sewage disposal system operation permit should not have been issued by the Spotsylvania County Health Department for the sewage disposal system as initially installed; and Whereas, the Taylors have no means to recover the expenses they incurred relating to the emergency pump-out and replacement of their sewage disposal system; now, therefore, Be it enacted by the General Assembly of Virginia: 1. § 1. That there is hereby allocated from the general funds appropriated to the Department of Health the sum of $1,183 for the relief of Frank and Amy Taylor, to be paid by check issued by the State Treasurer on warrant of the Comptroller upon execution of a release of all claims Frank and Amy Taylor may have against the Commonwealth or any agency, instrumentality, office, employee, or political subdivision in connection with the aforesaid occurrence. |
