Summary

Procedure in bifurcated trial. Clarifies that when a jury cannot agree on punishment in the punishment phase of a bifurcated trial, the court shall impanel a different jury to ascertain punishment unless the defendant, the attorney for the Commonwealth, and the court agree that the court shall fix punishment. The current statute is silent on impaneling a different jury.
