Summary
To prohibit the Commissioner of Social Security from furnishing the name of any individual in a report to the National Instant Criminal Background Check System unless a Federal court has determined the individual to be mentally defective. This bill prohibits the Social Security Administration from providing to the National Instant Criminal Background Check System (NICS) the name of any individual entitled to benefits, including any individual whose benefits are paid to a representative payee, unless a federal court has determined the individual to be mentally defective. (Current law prohibits the sale or transfer of a firearm to and the purchase or possession of a firearm by a person who has been adjudicated as a mental defective or committed to a mental institution.)
