relating to the eligibility of certain officers of a political | ||

same time certain other offices. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 180, Local Government Code, is amended | ||
by adding Section 180.0055 to read as follows: | ||
Sec. 180.0055. ELIGIBILITY OF CERTAIN ELECTED OR APPOINTED | ||
OFFICERS TO HOLD CERTAIN OTHER OFFICES. (a) This section applies | ||
only to an elected or appointed office of a political subdivision | ||
authorized to impose a tax or issue bonds. This section applies only | ||
to the extent it does not conflict with a provision of the state | ||
constitution. | ||
(b) An officer who holds an office to which this section | ||
applies is not eligible to hold at the same time another office to | ||
which this section applies. | ||
SECTION 2. Not later than the effective date of this Act, an | ||
officer who holds more than one office in violation of Section | ||
180.0055, Local Government Code, as added by this Act, shall | ||
resign, effective on that date, from each office necessary to allow | ||
the officer to be in compliance with the requirement of that | ||
section. | ||
SECTION 3. This Act takes effect September 1, 2023. |
