A BILL TO BE ENTITLED
 
AN ACT
 
  relating to formula funding for certain nonresident students
  enrolled at Lamar State College--Orange.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 61.059, Education Code, is amended by
  adding Subsection (n-1) to read as follows:
         (n-1)  In the formula applicable to Lamar State
  College--Orange for funding instruction and administration, the
  board shall include any contact hours taught through distance
  education to students enrolled at that college who reside in
  another state and:
               (1)  as permitted by Section 54.231(a), pay tuition at
  the rate charged to residents of this state; and
               (2)  reside in a county or parish in the other state
  that is contiguous to the county in which the college is located.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
