| relating to term limitation for United States Senators from Texas. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 145, Election Code, is amended by adding | ||
| new section 145.040 to read as follows: | ||
| Sec. 145.040. UNITED STATES SENATE CANDIDATE ELIGIBILITY. | ||
| No person who has served two terms as a United States Senator shall | ||
| be eligible for election or appointment to the United States Senate | ||
| from Texas. For purposes of this section, the election or | ||
| appointment of a person to fill a vacancy in the United States | ||
| Senate shall be included as one term in determining the number of | ||
| terms that such person has served as a United States Senator if the | ||
| person fills the vacancy for more than three years. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
