A BILL TO BE ENTITLED
 
AN ACT
  relating to term limitation for United States Senators from Texas.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 145, Election Code, is amended by adding
  new section 145.040 to read as follows:
         Sec. 145.040.  UNITED STATES SENATE CANDIDATE ELIGIBILITY.
  No person who has served two terms as a United States Senator shall
  be eligible for election or appointment to the United States Senate
  from Texas. For purposes of this section, the election or
  appointment of a person to fill a vacancy in the United States
  Senate shall be included as one term in determining the number of
  terms that such person has served as a United States Senator if the
  person fills the vacancy for more than three years.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
