relating to the notice of rulemaking proceedings provided to | ||
certain persons by state agencies. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 2001.0261, Government Code, is amended | ||
by amending Subsections (c) and (d) and adding Subsection (e) to | ||
read as follows: | ||
(c) A [ |

under Subsection (b) electronically to the recipient's [ |
||
designated Capitol e-mail address or to another e-mail address | ||
provided by the recipient [ |
||
receiving the notice. The notice must: | ||
(1) be specifically addressed and directed to the | ||
recipient; | ||
(2) include the bill number for the legislation that | ||
enacted the statutory authority under which the proposed rule that | ||
is the subject of the notice is to be adopted; and | ||
(3) if practicable, provide a link to the proposed | ||
rule that is the subject of the notice or include a copy of the | ||
proposed rule as an attachment to the notice. | ||
(d) A state agency may not provide the notice required under | ||
Subsection (b) to a recipient by: | ||
(1) including the recipient on an e-mail list service | ||
the agency uses to provide periodic announcements of the agency's | ||
proposed rules to members of the public or the legislature | ||
generally; or | ||
(2) providing the notice in an e-mail sent by the | ||
agency in its regular course of business to multiple recipients. | ||
(e) Failure to provide the notice required under Subsection | ||
(b) does not invalidate a rule adopted by a state agency or an | ||
action taken by the agency under that rule. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a notice under Section 2001.0261, Government Code, provided on | ||
or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2025. |
