| relating to requiring public institutions of higher education to | ||
| make available to students certain pregnancy-related informational | ||
| materials published by the Department of State Health Services. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter Z, Chapter 51, Education Code, is | ||
| amended by adding Section 51.9196 to read as follows: | ||
| Sec. 51.9196. REQUIRED INFORMATION FOR STUDENTS RELATED TO | ||
| PREGNANCY RESOURCES. (a) In this section: | ||
| (1) "Institution of higher education" has the meaning | ||
| assigned by Section 61.003. | ||
| (2) "QR code" has the meaning assigned by Section | ||
| 443.001, Health and Safety Code. | ||
| (b) The student health center of each institution of higher | ||
| education shall: | ||
| (1) make available at no cost to students the | ||
| informational materials described by Section 171.014, Health and | ||
| Safety Code, in a printed format; and | ||
| (2) post in a conspicuous location at the student | ||
| health center a sign containing a QR code that may be scanned and | ||
| that leads to the Internet website described by Section 171.014(e), | ||
| Health and Safety Code. | ||
| (c) The executive commissioner of the Health and Human | ||
| Services Commission by rule shall prescribe the design and content | ||
| of the sign required to be posted under this section. | ||
| SECTION 2. Not later than January 15, 2024, the executive | ||
| commissioner of the Health and Human Services Commission shall | ||
| adopt rules as required by Section 51.9196(c), Education Code, as | ||
| added by this Act. | ||
| SECTION 3. This Act applies beginning with the 2024 spring | ||
| semester. | ||
| SECTION 4. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
