A BILL TO BE ENTITLED
 
AN ACT
  relating to required reporting regarding a school district's
  program for gifted and talented students.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 29, Education Code, is
  amended by adding Section 29.124 to read as follows:
         Sec. 29.124.  PEIMS REPORTING REQUIREMENTS. Each school
  district shall include the following information in the district's
  Public Education Information Management System (PEIMS) report:
               (1)  the name and contact information of the district
  administrator responsible for ensuring that the district is in
  compliance with this subchapter;
               (2)  whether the district uses data from an entire
  grade level to identify gifted and talented students; and
               (3)  if applicable, the grade levels for which the
  district identifies gifted and talented students as described by
  Subdivision (2).
         SECTION 2.  Section 39.306, Education Code, is amended by
  amending Subsection (d-1) and adding Subsection (d-2) to read as
  follows:
         (d-1)  The comparison provided by the agency under
  Subsection (d) must include a comparison of college, career, and
  military readiness achievement between students served in a program
  for gifted and talented students and students served in other
  programs.
         (d-2)  The report must also include the number of school
  counselors providing counseling services at each campus.
         SECTION 3.  This Act applies beginning with the 2023-2024
  school year.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
