relating to certain powers and duties of a drainage district. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 56.111, Water Code, is amended to read as | ||
follows: | ||
Sec. 56.111. CONTROL AND REPAIR OF DISTRICT IMPROVEMENTS. | ||
(a) The board may control and supervise the construction and | ||
maintenance of canals, drains, ditches and levees, and other | ||
improvements of the district and shall keep them in repair. | ||
(b) Notwithstanding any other law, a district described by | ||
this subsection may control, supervise, finance, purchase, | ||
construct, acquire, own, operate, maintain, repair, improve, and | ||
extend inside and outside its boundaries any works, improvements, | ||
facilities, plants, equipment, and appliances necessary to | ||
accomplish the creation and operation of a stormwater reclamation | ||
system and may issue related bonds. This subsection applies only to | ||
a district located in a county that is located adjacent to the | ||
United Mexican States, has a population of more than 800,000, and | ||
contains at least two municipalities each of which has a population | ||
of 70,000 or more. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
