relating to taking sand, gravel, marl, shell, and mudshell from | ||
Texas rivers. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 86, Parks and Wildlife Code, is amended | ||
by adding Section 86.01915 to read as follows: | ||
Sec. 86.01915. EXEMPTION FOR CERTAIN DISTRICTS. (a) This | ||
section applies only to a conservation and reclamation district | ||
created or operating under Section 59, Article XVI, Texas | ||
Constitution. | ||
(b) A district may take sand, gravel, marl, shell, or | ||
mudshell from any river or tributary to restore, maintain, or | ||
expand the capacity of the river and its tributaries to convey storm | ||
flows. | ||
(c) A district acting under this section is not required to: | ||
(1) obtain a permit or pay a fee to take sand, gravel, | ||
marl, shell, or mudshell under Subsection (b); or | ||
(2) purchase sand, gravel, marl, shell, or mudshell | ||
taken under Subsection (b). | ||
(d) A district acting under this section may deposit sand, | ||
gravel, marl, shell, or mudshell taken under Subsection (b) on | ||
private land. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
