| relating to the payment of certain employer contributions for | ||
| employed retirees of the Teacher Retirement System of Texas. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 825.4092, Government Code, is amended by | ||
| adding Subsection (f) to read as follows: | ||
| (f) A reporting employer is ultimately responsible for | ||
| payment of the amounts required to be contributed under Subsections | ||
| (b) and (c). The employer may not directly or indirectly pass that | ||
| cost on to the retiree through payroll deduction, by imposition of a | ||
| fee, or by any other means designed to recover the cost. | ||
| SECTION 2. The changes in law made by this Act apply to a | ||
| retiree of the Teacher Retirement System of Texas regardless of | ||
| whether the person retired from employment before, on, or after the | ||
| effective date of this Act. | ||
| SECTION 3. The changes in law made by this Act apply | ||
| beginning with the 2021-2022 school year. | ||
| SECTION 4. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
