A BILL TO BE ENTITLED
 
AN ACT
  relating to the residency requirements for hunting and fishing
  licenses.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 42.001, Parks and Wildlife Code, is
  amended by amending Subdivision (1) and adding Subdivision (9) to
  read as follows:
               (1)  "Resident" means:
                     (A)  an individual who has resided continuously in
  this state for more than six months immediately before applying for
  a hunting license;
                     (B)  a member of the United States armed forces on
  active duty;
                     (C)  a dependent of a member of the United States
  armed forces on active duty;
                     (D)  if approved by the director, a terminally ill
  individual who is participating in an event sponsored by a
  charitable nonprofit organization;
                     (E)  a seasonal resident; or
                     (F) [(E)]  a member of any other category of
  individuals that the commission by regulation designates as
  residents.
               (9)  "Seasonal resident" means an individual who
  resides in this state for not less than 90 days in a calendar year.
         SECTION 2.  Section 46.0011, Parks and Wildlife Code, is
  amended by amending Subdivision (1) and adding Subdivision (3) to
  read as follows:
               (1)  "Resident" means:
                     (A)  an individual who has resided continuously in
  this state for more than six months immediately before applying for
  a fishing license required by this chapter;
                     (B)  a member of the United States armed forces on
  active duty;
                     (C)  a dependent of a member of the United States
  armed forces on active duty;
                     (D)  a seasonal resident; or
                     (E) [(D)]  a member of any other category of
  individuals that the commission by regulation designates as
  residents.
               (3)  "Seasonal resident" means an individual who
  resides in this state for not less than 90 days in a calendar year.
         SECTION 3.  Section 50.0011, Parks and Wildlife Code, is
  amended to read as follows:
         Sec. 50.0011.  DEFINITIONS [DEFINITION]. In this chapter:
               (1)  "Resident" [, "resident"] means:
                     (A) [(1)]  an individual who has resided
  continuously in this state for more than six months immediately
  before applying for a license issued under this chapter;
                     (B) [(2)]  a member of the United States armed
  forces on active duty;
                     (C) [(3)]  a dependent of a member of the United
  States armed forces on active duty;
                     (D)  a seasonal resident; or
                     (E) [(4)]  a member of any other category of
  individuals that the commission by regulation designates as
  residents.
               (2)  "Seasonal resident" means an individual who
  resides in this state for not less than 90 days in a calendar year.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
