| relating to the authority of a general-law municipality to annex | ||

| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 43.033, Local Government Code, is | ||
| amended by adding Subsection (c) to read as follows: | ||
| (c) Subsection (a)(3) does not apply to a municipality that | ||
| annexes an area that receives water and sewer service from a | ||
| municipal utility district that provides water and sewer service to | ||
| all or part of the municipality. | ||
| SECTION 2. Section 43.033, Local Government Code, as | ||
| amended by this Act, applies only to an annexation of an area for | ||
| which a municipality institutes proceedings to annex the area on or | ||
| after the effective date of this Act. The annexation of an area for | ||
| which a municipality institutes annexation proceedings before that | ||
| date is governed by the law in effect immediately before the | ||
| effective date of this Act, and the former law is continued in | ||
| effect for that purpose. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
