BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. The heading to Chapter 55, Occupations Code, is | ||
amended to read as follows: | ||
CHAPTER 55. [ |

SECTION 2. Chapter 55, Occupations Code, is amended by | ||
adding Section 55.004 to read as follows: | ||
Sec. 55.004. ALTERNATIVE LICENSE PROCEDURE FOR MILITARY | ||
SPOUSE. (a) A state agency that issues a license shall adopt rules | ||
for the issuance of a license to an applicant who is the spouse of a | ||
person serving on active duty as a member of the armed forces of the | ||
United States. | ||
(b) Rules adopted under this section must include | ||
provisions to allow: | ||
(1) alternative demonstrations of competency to meet | ||
the requirements for obtaining the license; and | ||
(2) a period during which an otherwise qualified | ||
person may seek employment or practice with an expired license. | ||
(c) The executive director of the Texas Department of | ||
Licensing and Regulation may issue a license by endorsement in the | ||
same manner as the Texas Commission of Licensing and Regulation | ||
under Section 51.404 to an applicant described by Subsection (a). | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. | ||
