materials for public school students. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter A, Chapter 28, Education Code, is | ||
amended by adding Section 28.0044 to read as follows: | ||
Sec. 28.0044. MENSTRUAL DISORDERS EDUCATION AND | ||
INFORMATIONAL MATERIALS. (a) In this section, "age-appropriate" | ||
means suitable to particular ages or age groups of children or | ||
adolescents, based on developing cognitive, emotional, and | ||
behavioral capacity typical for the age or age group. | ||
(b) A school district may provide to students education and | ||
informational materials regarding menstrual disorders at grade | ||
levels and in courses considered appropriate by the district. | ||
(c) The State Board of Education by rule shall adopt a list | ||
of age-appropriate informational materials regarding menstrual | ||
disorders and symptoms of menstrual disorders. The materials must | ||
include information on: | ||
(1) the timing, signs, and symptoms of endometriosis | ||
and other menstrual disorders; | ||
(2) the importance of menstrual health and the impact | ||
of menstrual health on a person's physical and emotional | ||
well-being, social interactions, and academic performance; | ||
(3) basic statistics on endometriosis and other | ||
menstrual disorders; | ||
(4) best practices regarding methods to advocate for | ||
one's own health care; and | ||
(5) basic treatment options for endometriosis and | ||
other menstrual disorders and recommendations for follow-up care | ||
from a health care provider. | ||
(d) The State Board of Education shall make available to a | ||
school district on request any informational materials included on | ||
the list adopted under Subsection (c). | ||
SECTION 2. This Act applies beginning with the 2023-2024 | ||
school year. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2023. |
