relating to a highway toll exemption for certain vehicles that are | ||
owned by or operated on behalf of public schools or open-enrollment | ||
charter schools. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 372, Transportation Code, | ||
is amended by adding Section 372.059 to read as follows: | ||
Sec. 372.059. CERTAIN SCHOOL VEHICLES. (a) A toll project | ||
entity may not require the payment of a toll for use of a toll | ||
project by a vehicle that is exempt from registration fees under | ||
Section 502.453 and is: | ||
(1) owned by and used exclusively in the service of: | ||
(A) a school district in this state; or | ||
(B) an open-enrollment charter school; or | ||
(2) owned by a commercial transportation company and | ||
used exclusively to provide public school transportation services | ||
to a school district under Section 34.008, Education Code. | ||
(b) This section does not apply to the use of a toll project | ||
for which the terms of financial assistance provided for the | ||
project or bonds issued for the project prohibit the toll project | ||
entity that operates the project from providing the toll exemption | ||
required by this section. | ||
SECTION 2. This Act takes effect September 1, 2021. |
