| proposing a constitutional amendment to prohibit the state or a | ||
| governmental entity in the state from providing support for the | ||
| performance of an abortion or abortion-related services. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article III, Texas Constitution, is amended by | ||
| adding Section 52l to read as follows: | ||
| Sec. 52l. This state or a governmental entity in this state | ||
| may not provide support to a person or facility that performs | ||
| abortions or provides abortion-related services. Support | ||
| includes: | ||
| (1) directly or indirectly using state or local tax | ||
| revenue to finance the performance of an abortion or a service | ||
| related to an abortion; and | ||
| (2) providing preferential access to assets that are | ||
| owned or controlled by this state or a governmental entity in this | ||
| state through a lease, contract, or other agreement. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 8, 2011. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment to prohibit the state | ||
| or a governmental entity in the state from providing support for the | ||
| performance of an abortion or abortion-related services." | ||
