proposing a constitutional amendment regarding public free schools | ||
and prohibiting certain state regulation regarding private | ||
educational settings. | ||
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 1, Article VII, Texas Constitution, is | ||
amended to read as follows: | ||
Sec. 1. (a) A general diffusion of knowledge being | ||
essential to the preservation of the liberties and rights of the | ||
people, it shall be the duty of the Legislature of the State to | ||
establish, ensure public oversight of, and make suitable provision | ||
for the support and maintenance of an efficient system of public | ||
free schools. | ||
(b) Each child of school age who resides in this state is | ||
entitled to access, with the consent of the child's parent, a public | ||
free school. | ||
(c) The state may not: | ||
(1) abridge the right of a parent to place the parent's | ||
child in an educational setting of the parent's choice outside of | ||
the public free schools; or | ||
(2) regulate the provision of education in an | ||
educational setting for which the state does not provide support or | ||
maintenance. | ||
SECTION 2. This proposed constitutional amendment shall be | ||
submitted to the voters at an election to be held November 7, 2023. | ||
The ballot shall be printed to permit voting for or against the | ||
proposition: "The constitutional amendment regarding public free | ||
schools and prohibiting certain state regulation regarding private | ||
educational settings." |
