| relating to increasing fiscal flexibility through the provision of | ||
| state aid for certain juvenile justice alternative education | ||
| programs that enter into certain revenue sharing agreements. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. (a) This section applies only to a juvenile | ||
| justice alternative education program that, for the 2005-2006 | ||
| school year, received funding as a result of an agreement between | ||
| school districts under Subchapter E, Chapter 41, Education Code. | ||
| (b) A juvenile justice alternative education program is | ||
| entitled to state aid under this section in an amount equal to: | ||
| (1) for the 2011-2012 school year, the difference | ||
| between: | ||
| (A) the funding the program received as a result | ||
| of all agreements between school districts under Subchapter E, | ||
| Chapter 41, Education Code, for the 2005-2006 school year; and | ||
| (B) the funding the program receives as a result | ||
| of all agreements between school districts under Subchapter E, | ||
| Chapter 41, Education Code, for the 2011-2012 school year; and | ||
| (2) for the 2012-2013 school year, the difference | ||
| between: | ||
| (A) the funding the program received as a result | ||
| of all agreements between school districts under Subchapter E, | ||
| Chapter 41, Education Code, for the 2005-2006 school year; and | ||
| (B) the funding the program receives as a result | ||
| of all agreements between school districts under Subchapter E, | ||
| Chapter 41, Education Code, for the 2012-2013 school year. | ||
| (c) The commissioner of education shall: | ||
| (1) determine the amount of state aid to which a | ||
| juvenile justice alternative education program is entitled under | ||
| this section; and | ||
| (2) distribute the aid in 10 equal monthly | ||
| installments: | ||
| (A) for the 2011-2012 school year, beginning with | ||
| September 2011 and ending with June 2012; and | ||
| (B) for the 2012-2013 school year, beginning with | ||
| September 2012 and ending with June 2013. | ||
| (d) To fund a distribution authorized under Subsection | ||
| (c)(2), the commissioner of education may reallocate money in the | ||
| Texas Education Agency's budget, to the extent otherwise authorized | ||
| by law, or use other available funds. | ||
| (e) The commissioner of education shall adopt rules to | ||
| implement this section. | ||
| (f) A determination of the commissioner of education under | ||
| this section is final and may not be appealed. | ||
| SECTION 2. This Act takes effect on the 91st day after the | ||
| last day of the legislative session. | ||
