relating to the authority of the Public Utility Commission of Texas | ||
to set wholesale electricity prices in the ERCOT power region | ||
during a state of disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 39.151, Utilities Code, is amended by | ||
adding Subsection (d-5) to read as follows: | ||
(d-5) Notwithstanding Subsection (d), during a state of | ||
disaster declared by the governor under Chapter 418, Government | ||
Code, in response to an extreme weather event, the commission may | ||
not by order raise the wholesale price of electric energy sold in | ||
the ERCOT power region for the purpose of correcting the price of | ||
electric energy to match the demand for electric energy. | ||
SECTION 2. This Act takes effect September 1, 2021. |
