| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 39.151, Utilities Code, is amended by | ||
| adding Subsection (d-5) to read as follows: | ||
| (d-5) Notwithstanding Subsection (d), during a state of | ||
| disaster declared by the governor under Chapter 418, Government | ||
| Code, in response to an extreme weather event, the commission may | ||
| not by order raise the wholesale price of electric energy sold in | ||
| the ERCOT power region for the purpose of correcting the price of | ||
| electric energy to match the demand for electric energy. | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
