relating to Medicaid coverage and reimbursement for certain | ||
cancer-related treatments or items. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 32, Human Resources Code, | ||
is amended by adding Section 32.0427 to read as follows: | ||
Sec. 32.0427. REIMBURSEMENT FOR CERTAIN CANCER-RELATED | ||
TREATMENTS OR ITEMS. The commission shall ensure that medical | ||
assistance reimbursement is provided to a health care provider for | ||
providing the following treatments or items in relation to cancer | ||
treatment: | ||
(1) physical therapy; | ||
(2) dental services related to the effects of | ||
chemotherapy or radiation, including: | ||
(A) oral surgery; | ||
(B) dental implants; | ||
(C) dental veneers; and | ||
(D) dentures; | ||
(3) compression garments, including: | ||
(A) sleeves; | ||
(B) garners; and | ||
(C) gauntlets; and | ||
(4) mastectomy products, including: | ||
(A) shells; | ||
(B) shapers; and | ||
(C) prostheses. | ||
SECTION 2. If before implementing any provision of this Act | ||
a state agency determines that any other waiver or authorization | ||
from a federal agency is necessary for implementation of that | ||
provision, the agency affected by the provision shall request the | ||
waiver or authorization and may delay implementing that provision | ||
until the waiver or authorization is granted. | ||
SECTION 3. This Act takes effect September 1, 2023. |
