A BILL TO BE ENTITLED
 
AN ACT
  relating to exceptions to municipal plat requirements for certain
  property developments.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 212.0046, Local Government Code, is
  amended to read as follows:
         Sec. 212.0046.  EXCEPTION TO PLAT REQUIREMENT: CERTAIN
  PROPERTY ABUTTING AIRCRAFT RUNWAY. An owner of a tract of land is
  not required to prepare a plat if the land:
               (1)  is located wholly within a municipality with a
  population of 65,000 [5,000] or less;
               (2)  is divided into parts larger than 2-1/2 acres; and
               (3)  abuts any part of an aircraft runway.
         SECTION 2.  Subchapter B, Chapter 212, Local Government
  Code, is amended by adding Section 212.0455 to read as follows:
         Sec. 212.0455.  EXCEPTION TO PLAT REQUIREMENT: MUNICIPAL
  DETERMINATION. To determine whether specific developments of
  tracts of land are required to be platted under this subchapter, a
  municipality may define and classify the developments. A
  municipality need not require platting for every development of a
  tract of land otherwise within the scope of this subchapter.
         SECTION 3.  This Act takes effect September 1, 2023.
