relating to the release of deer by certain deer breeder facilities | ||
to a low-fenced site. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 43.361(a), Parks and Wildlife Code, is | ||
amended to read as follows: | ||
(a) Except as provided by Section 43.3615, a [ |
||
site onto which breeder deer are liberated must be surrounded by a | ||
fence not less than seven feet in height that is capable of | ||
retaining deer at all times under reasonable and ordinary | ||
circumstances. | ||
SECTION 2. Subchapter L, Chapter 43, Parks and Wildlife | ||
Code, is amended by adding Section 43.3615 to read as follows: | ||
Sec. 43.3615. RELEASE BY CERTAIN DEER BREEDER FACILITIES TO | ||
LOW-FENCED SITE. (a) A deer breeder facility with the highest | ||
status transfer category as determined by commission rule may | ||
release breeder deer to a low-fenced site that: | ||
(1) includes at least 5,000 acres of contiguous land; | ||
and | ||
(2) is within 200 miles of the deer breeder facility. | ||
(b) The commission shall adopt rules governing a release of | ||
breeder deer under this section. | ||
SECTION 3. This Act takes effect September 1, 2021. |
