A BILL TO BE ENTITLED
 
AN ACT
  relating to the provision of municipal services to a property in the
  extraterritorial jurisdiction of a municipality following the
  municipality's denial or refusal to permit an activity or structure
  on the property.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter Z, Chapter 42, Local Government Code,
  is amended by adding Section 42.905 to read as follows:
         Sec. 42.905.  PROVISION OF MUNICIPAL SERVICES IN
  EXTRATERRITORIAL JURISDICTION UNDER CERTAIN CIRCUMSTANCES. A
  municipality that extends to its extraterritorial jurisdiction the
  application of a municipal ordinance or rule and denies or refuses
  to permit an activity or structure on a property in that area under
  the ordinance or rule shall provide to the property the municipal
  services described by Section 43.056(b) not later than 30 months
  after the date of the denial or refusal.
         SECTION 2.  This Act takes effect September 1, 2023.
