BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subtitle A, Title 4, Local Government Code, is | ||
amended by adding Chapter 109 to read as follows: | ||
CHAPTER 109. FEES CHARGED BY MUNICIPALITIES | ||
Sec. 109.001. RECORDS MANAGEMENT AND PRESERVATION FEE. (a) | ||
Except as provided by Subsection (b), a municipality may collect a | ||
records management and preservation fee not to exceed $1 for any | ||
municipal authorization, permit, license, registration, | ||
certification, filing, or other municipal action or approval. | ||
(b) A municipality may not collect a records management and | ||
preservation fee under this section from a certified | ||
telecommunications provider subject to access line fees under | ||
Chapter 283. | ||
(c) The records management and preservation fee must be | ||
deposited in a separate records management and preservation account | ||
in the general fund of the municipality. | ||
(d) The records management and preservation fee may be used | ||
only to provide funds for specific records management and | ||
preservation, including municipal library and archival services. | ||
SECTION 2. This Act takes effect September 1, 2021. |
