| management and preservation fee. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subtitle A, Title 4, Local Government Code, is | ||
| amended by adding Chapter 109 to read as follows: | ||
| CHAPTER 109. FEES CHARGED BY MUNICIPALITIES | ||
| Sec. 109.001. RECORDS MANAGEMENT AND PRESERVATION FEE. (a) | ||
| Except as provided by Subsection (b), a municipality may collect a | ||
| records management and preservation fee not to exceed $1 for any | ||
| municipal authorization, permit, license, registration, | ||
| certification, filing, or other municipal action or approval. | ||
| (b) A municipality may not collect a records management and | ||
| preservation fee under this section from a certified | ||
| telecommunications provider subject to access line fees under | ||
| Chapter 283. | ||
| (c) The records management and preservation fee must be | ||
| deposited in a separate records management and preservation account | ||
| in the general fund of the municipality. | ||
| (d) The records management and preservation fee may be used | ||
| only to provide funds for specific records management and | ||
| preservation, including municipal library and archival services. | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
