A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of a municipality to collect a records
  management and preservation fee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle A, Title 4, Local Government Code, is
  amended by adding Chapter 109 to read as follows:
  CHAPTER 109. FEES CHARGED BY MUNICIPALITIES
         Sec. 109.001.  RECORDS MANAGEMENT AND PRESERVATION FEE. (a)
  Except as provided by Subsection (b), a municipality may collect a
  records management and preservation fee not to exceed $1 for any
  municipal authorization, permit, license, registration,
  certification, filing, or other municipal action or approval.
         (b)  A municipality may not collect a records management and
  preservation fee under this section from a certified
  telecommunications provider subject to access line fees under
  Chapter 283.
         (c)  The records management and preservation fee must be
  deposited in a separate records management and preservation account
  in the general fund of the municipality.
         (d)  The records management and preservation fee may be used
  only to provide funds for specific records management and
  preservation, including municipal library and archival services.
         SECTION 2.  This Act takes effect September 1, 2021.
