A BILL TO BE ENTITLED
 
AN ACT
  relating to the resignation of a public school teacher employed
  under a term contract.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 21.210(b), Education Code, is amended to
  read as follows:
         (b)  A teacher employed under a term contract may resign:
               (1)  [,] with the consent of the board of trustees or
  the board's designee, at any other time; or
               (2)  at any time during which a state of emergency or
  state of disaster has been declared by the governor or the president
  of the United States or a pandemic has been declared by the World
  Health Organization:
                     (A)  for the geographic area in which the school
  district that employs the teacher is located; or
                     (B)  that may reasonably be anticipated to impact
  or jeopardize the teacher's health or well-being.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
