| residential rental units. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter B, Chapter 92, Property Code, is | ||
| amended by adding Section 92.0521 to read as follows: | ||
| Sec. 92.0521. LANDLORD'S DUTY TO INSPECT FOR AND TREAT | ||
| BEDBUGS; DISCLOSURE. (a) Except as provided by Subsection (b), | ||
| during a tenant's lease term or during a renewal or extension, the | ||
| landlord has a duty to inspect and treat, at the landlord's expense, | ||
| the leased premises for bedbugs. | ||
| (b) A tenant may decline in writing the landlord's | ||
| inspection for and treatment of bedbugs under Subsection (a). | ||
| (c) A provision stating the landlord's duty under this | ||
| section must be included in a lease agreement signed by the tenant. | ||
| SECTION 2. Section 92.0521, Property Code, as added by this | ||
| Act, applies only to a lease entered into or renewed on or after the | ||
| effective date of this Act. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
