A BILL TO BE ENTITLED
 
AN ACT
  relating to a landlord's duty to inspect for and treat bedbugs in
  residential rental units.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 92, Property Code, is
  amended by adding Section 92.0521 to read as follows:
         Sec. 92.0521.  LANDLORD'S DUTY TO INSPECT FOR AND TREAT
  BEDBUGS; DISCLOSURE. (a) Except as provided by Subsection (b),
  during a tenant's lease term or during a renewal or extension, the
  landlord has a duty to inspect and treat, at the landlord's expense,
  the leased premises for bedbugs.
         (b)  A tenant may decline in writing the landlord's
  inspection for and treatment of bedbugs under Subsection (a).
         (c)  A provision stating the landlord's duty under this
  section must be included in a lease agreement signed by the tenant.
         SECTION 2.  Section 92.0521, Property Code, as added by this
  Act, applies only to a lease entered into or renewed on or after the
  effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2021.
