relating to a landlord's duty to inspect for and treat bedbugs in | ||
residential rental units. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 92, Property Code, is | ||
amended by adding Section 92.0521 to read as follows: | ||
Sec. 92.0521. LANDLORD'S DUTY TO INSPECT FOR AND TREAT | ||
BEDBUGS; DISCLOSURE. (a) Except as provided by Subsection (b), | ||
during a tenant's lease term or during a renewal or extension, the | ||
landlord has a duty to inspect and treat, at the landlord's expense, | ||
the leased premises for bedbugs. | ||
(b) A tenant may decline in writing the landlord's | ||
inspection for and treatment of bedbugs under Subsection (a). | ||
(c) A provision stating the landlord's duty under this | ||
section must be included in a lease agreement signed by the tenant. | ||
SECTION 2. Section 92.0521, Property Code, as added by this | ||
Act, applies only to a lease entered into or renewed on or after the | ||
effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2021. |
