| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 43.955, Parks and Wildlife Code, is | ||
| amended to read as follows: | ||
| Sec. 43.955. COST RECOVERY. (a) The applicable permit | ||
| holder shall pay all costs associated with[ |

| this subchapter to the animal health commission[ |
||

| (b) A permit holder under Subchapter R or R-1 shall pay all | ||
| costs associated with the destruction of deer under this subchapter | ||
| to the department. | ||
| (c) The department shall pay the cost of a breeder deer | ||
| destroyed under this subchapter to the holder of the permit under | ||
| Subchapter L who held the breeder deer in captivity for the purpose | ||
| of propagation. The amount paid under this section is $3,000 per | ||
| deer or an amount set by the commission, whichever is higher. | ||
| SECTION 2. The change in law made by this Act applies to the | ||
| destruction of a deer on or after the effective date of this Act. | ||
| The destruction of a deer before the effective date of this Act is | ||
| governed by the law in effect at the time the deer was destroyed and | ||
| that law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
