A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of certain counties to regulate recycling
  businesses.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 234, Local Government
  Code, is amended by adding Section 234.0025 to read as follows:
         Sec. 234.0025.  REGULATION OF RECYCLING BUSINESSES. (a)
  This section applies only to a county:
               (1)  in which a municipality with a population of
  500,000 or more is located; and
               (2)  that is located on an international border.
         (b)  The commissioners court of a county to which this
  section applies by order may regulate the operation of a recycling
  business located in the unincorporated area of the county.
         (c)  A commissioners court may not include in an order
  adopted under this section a requirement that conflicts with a
  similar requirement prescribed by another law governing a recycling
  business, including a requirement prescribed by Chapter 396,
  Transportation Code.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2025.
